What does it mean for infertility care?
The overturning of Roe v. Wade has caused a cascade of patient questions. Currently, North Carolina allows abortions until 20 weeks gestation, and there is no sign that state law will be challenged this year. This means there is NO immediate change in our patients’ access to IVF, embryo freezing or genetic testing of embryos. Nor is there any need to ship embryos out of state.
What’s at stake: If an abortion ban were to take effect, legal definitions of when life begins could affect a fertility clinic’s ability to perform IVF (the creation of embryos by fertilizing eggs in a lab), embryo freezing (cryopreservation of fertilized eggs) and genetic testing of embryos.
Even if North Carolina abortion laws were to change, we have reason to hope that IVF would be excluded. The Washington Post reports that over the last decade, state legislatures have explicitly excluded IVF technology from abortion bans. Many see IVF as a non-ethical issue and a highly beneficial medical treatment for family building.
